A Woodhall Spa man performed a sexual act while sitting next to a pensioner on a bus, Lincoln Crown Court was told.

Peter Lake, 34, of Arnhem Way, was on the back seat of the single decker Brylaine service travelling from Woodhall Spa to Lincoln when his behaviour began to cause concern for the 77 year old man sitting next to him.

Andrew Scott, prosecuting, said “The pensioner noticed that the defendant was fiddling with his groin area.

“As the bus made its way towards Potterhanworth, the man pensioner turned and looked down. He saw the defendant masturbating himself. The man could not believe what he was seeing.

“The defendant’s shirt was outside of his trousers covering his groin area. The bus, at the time, was relatively full.”

The pensioner asked Lake was he was doing and the defendant replied: “Please don’t report me. I’m in enough trouble already.”

Later, when Lake went to get off the bus, the pensioner complained to the driver but Lake was allowed to leave.

Lake was later identified as the culprit and made a full admission when he was interviewed by police.

Lake admitted a charge of outraging public decency as a result of the incident on June 13.

The court heard he had previous convictions for exposing himself - and for sexually assaulting a 91 year old woman.

Terry Boston, defending, said Lake suffered from learning difficulties and lived with his parents who support him.

He said: “Perhaps prison is not the place for him. He would have great difficulties there because of his learning difficulties.”

Lake was given a community order with 12 months supervision and 120 hours of unpaid work. He was also ordered to pay a £60 victim surcharge.

Judge Michael Heath told him: “You are described as of low IQ with a very limited understanding but you knew that what you were doing was wrong and you shouldn’t have been doing it.

“The time may come, if you don’t mend your ways, that I will have to lock you up.

“If you go on like this I’m going to have to.”
